Shoe, meet other foot. GamePolitics sends word that Take-Two, in an effort to preemptively stop Jack Thompson's insane and completely baseless attacks on the company and their games, is sueing the attorney. In the complaint Take-Two says that Thompson has a history of making threats of legal action and has done so again with Manhunt 2 and Grand Theft Auto IV. The suit alleges that Thompson's public nuisance tactic essentially violates Take Two's First Amendment rights. Lawyers for the game publisher argue that the Florida statute under which Thompson is seeking to have the games declared as nuisances essentially makes the controversial lawyer "a private attorney general on behalf of the State of Florida." I think Thompson is slowly working his way toward the super douche achievement, just five more frivolous suits to go and it unlocks for him. Thompson allegedly contacted Ars Technica with a response to the suit. The response, addressed to gamers and gamer publications on the Internet and elsewhere, started like this: I have been praying, literally, that Take-Two and its lawyers would do something so stupid, so arrogant, so dumb, even dumber than what they have to date done, that such a misstep would enable me to destroy Take-Two. With the filing of this SLAPP lawsuit last week, my prayers are finally answered. He went on to say that the lawsuit filed by Take-Two is "without a doubt, the single dumbest thing I have ever seen any lawyers do in my thirty years of practicing law". And here's where it gets biblical - he urged readers to read Psalm 35, a Psalm of David and for the sake of those who don't own a bible or those "who think their hands will catch on fire if they touch one," he posted some of the passages. It goes, 7 For without cause have they hid for me their net in a pit, which without cause they have digged for my soul.
8 Let destruction come upon him at unawares; and let his net that he hath hid catch himself: into that very destruction let him fall.
9 And my soul shall be joyful in the LORD: it shall rejoice in his salvation. He mentioned that the pit Take-Two has dug for itself will be clearer next week when "he strikes back." He then went on to say that "the entire Take-Two management and board will be gone on March 23 so the pit-digging comes at a very bad time." Jack Thompson countersues Take-TwoWe'll try to report this as blandly as possible since the talented Mr. Thompson will probably benefit from the press attention. Around a week ago we reported that Take-Two Interactive filed suit against Florida lawyer Jack Thompson, and that this was a preemptive move to keep said lawyer from making actions against the company in light of the upcoming releases of GTA IV and Manhunt 2. As expected, and promised by Mr. Thompson, he has filed his response to the Take-Two suit. He has also filed a countersuit that accuses Take-Two Interactive of multiple violations of the Racketeer Influenced and Corrupt Organizations Act (RICO), noting that the company has embarked on a continued effort to violate his constitutional rights since July 2005. Aside from the claims of infringement upon his rights, what's noteworthy about Thompson's defense is that he seems to have claimed that the ESRB has found that Take-Two Interactive failed to disclose objectionable content in its role-playing game The Elder Scrolls IV: Oblivion. The ESRB has said that it finds Bethesda Softworks at fault in that matter, not Take-Two. Thompson also claims that Take-Two had a lot of help in breaking the law. The countersuit he's prepared also mentions the ESA, Penny Arcade, GameSpot, as well as a number of other companies and media outlets as having conspired and collaborated with Take-Two to commit racketeering activities.
